Terms of Service

By using fillthechasm.com or engaging CHASM for services, you agree to these terms. If you are acting on behalf of an organization, you confirm you have authority to accept these terms for that organization.

CHASM provides marketing consulting services, which may include online presence setup, advertising strategy and management, Google Ad Grants application and management, and fractional marketing leadership. The specific scope of any engagement is defined in writing before work begins.

Descriptions on this website are summaries, not the full scope of any particular engagement. What we actually deliver for you is what we agree to in writing.

• —A deposit is required to reserve time or begin work. The deposit amount is shown at the point of purchase.
• —For the Get Visible package, the deposit is applied toward the total package price, and the remaining balance is invoiced before final delivery and handoff.
• —For calls, the deposit reserves your time and is applied toward your engagement if you proceed with us.
• —Invoices are due on receipt unless otherwise agreed in writing.
• —Ongoing monthly engagements are billed monthly in advance and continue until cancelled.

Payments are processed by Stripe. CHASM does not receive or store your card details.

• —Deposits are refundable within 24 hours of payment provided work has not yet begun.
• —If we fail to attend a scheduled call, your deposit is refunded in full.
• —Once work has begun, deposits cover time already invested and are non-refundable.
• —Monthly engagements can be cancelled with 30 days written notice. You are billed for the notice period.
• —Fees paid to third parties on your behalf, such as advertising spend, domain registration, or software subscriptions, are not refundable by CHASM.

Our ability to deliver on time depends on getting what we need from you. That includes timely responses, access to accounts and platforms where required, and any brand assets or business information the work depends on.

Where a project stalls because we are waiting on you, timelines shift accordingly. If a project remains inactive for 60 days due to lack of response, we may close it and treat any deposit as covering work completed to that point.

You confirm that any logos, images, copy, or other material you provide is yours to use, or that you have permission to use it. You are responsible for the accuracy of information you give us about your business.

Where you grant us access to your accounts, you retain ownership of those accounts. We use that access only to perform the agreed work, and access can be revoked by you at any time.

On full payment, you own the final deliverables produced specifically for you, including your website, ad copy, and brand materials we create. You also retain ownership of any accounts created for your business.

CHASM retains ownership of its underlying methods, templates, frameworks, and any general-purpose tools used to produce the work. We may reference the engagement in our portfolio and marketing unless you ask us in writing not to.

Marketing outcomes depend on many factors outside our control, including your market, competition, budget, pricing, offer, and platform changes made by Google, Meta, and others. Any figures, examples, or past results shown on this site are illustrative and are not a promise or guarantee of the results you will achieve.

Specific to Google Ad Grants: eligibility, approval, and continued participation are determined solely by Google. We manage applications and compliance to the best of our ability, but we cannot guarantee approval or that a grant will not be suspended.

Our work often depends on platforms we do not control, including Google, Meta, Stripe, and hosting providers. We are not responsible for outages, policy changes, account suspensions, or pricing changes imposed by those platforms, though we will help you respond to them.

We treat non-public information you share with us as confidential and use it only to perform the work. We expect the same in return regarding our proposals, pricing, and methods.

To the maximum extent permitted by law, CHASM's total liability arising from any engagement is limited to the amount you paid us for the services giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, including lost profits or lost business opportunity.

Nothing in these terms limits liability that cannot lawfully be limited.

Either party may end an engagement with written notice as described above. On termination, you pay for work completed to that date, and we hand over the deliverables and access associated with any work you have paid for in full.

We may update these terms. The version in effect when your engagement begins governs that engagement. Continued use of the website after changes means you accept the updated terms.
